Terms and Conditions
Please read the following terms and conditions very carefully as your use of service is subject to your acceptance of and compliance with the following terms and conditions ("Terms").
By subscribing to or using any of our services you agree that you have read, understood and are bound by the Terms, regardless of how you subscribe to or use the services. If you do not want to be bound by the Terms, you must not subscribe to or use our services.
In these Terms, references to "you", "User" shall mean the end user accessing the Website, its contents and using the Services offered through the Website. "Service Providers" mean independent third party service providers, and "we", "us" and "our" shall mean “ Italuxe Furniture”.
‘Buyer’ means the person who buys or agrees to buy the Products from the Seller.

‘Conditions’ means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.
‘Delivery Date’ means the date specified by the Seller when the Products are to be delivered.
‘Price’ means the price for the Products including VAT.
‘Products’ means those goods specified.
Nothing in these conditions shall affect the Buyer’s statutory rights as a consumer.
The Seller shall sell and the Buyer shall purchase the Products in accordance with a written quotation from the Seller which is accepted by the Buyer, or any written or verbal order of the Buyer which is accepted by the Seller including but not limited to orders placed via the Seller’s Web site, subject in any case to these conditions, which shall govern the contract to the exclusion of any other terms and conditions subject to which any such quotation is accepted or purported to be accepted, or any such order is made purported to be made, by the Buyer.
Any typographical or clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller.
When you place an order with us, you are making an offer to buy goods. We will send you an e-mail to confirm that we have received your order.
Once we have checked the price and availability of the goods, we will e-mail you again to confirm that we accept your order, And that a contract has been made between us. In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this.
You will not receive an e-mail confirming acceptance of your order, and there will be no contract between us. If the goods you order are not available, we may supply you with Substitute goods. If you decide not to accept the substitute goods, then you can have a refund of the amount paid towards the order.
Description of products
Italuxe makes every effort to describe the products offered for sale as precisely as possible. Italuxe reserves the right to add, remove or amend products without notice.
Dimensions where specified, are supplied by the manufacturers and displayed by us in good faith. They should be regarded as being for assistance only. If you are ordering an item where accurate dimensions are important, please contact us before ordering and we will make further enquiries on your behalf.
Payment for orders
When an order is placed, we will send out an order confirmation by email confirming the order with us. This constitutes a contract between you the customer and us (Italuxe) the retailer. All goods must be paid for prior to delivery. Delivery will only be arranged upon the full and complete payment towards the order. We accept all major credit and debit cards. We also provide the customer with an option of paying by cheque.
Goods faulty on arrival?
We do everything possible to ensure that our furniture is sent out in perfect condition and we employ extensive quality checks. However, we are all human and in the unlikely event that your goods do arrive faulty please e-mail email@example.com within 7 days with photos attached of the damage goods so that the replacement process will be faster and we will arrange for the goods to be collected and a replacement dispatched.
We generally reply to all our emails within 24 hrs.
Goods damaged in transit?
It is your responsibility to examine the goods for damage prior to signing for receipt of the goods. If you are not pleased with the condition of the goods you should inform the driver and refuse delivery. Once you have provided written receipt for the goods it is almost not possible for us to file a successful claim for compensation with the courier.
Cancellation of the order
You must inform us in writing, or in another durable medium, if you want to cancel. This includes letter, fax or email. A phone call is not acceptable. Under no conditions will we accept a cancellation after the 10 day period has expired.
You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future. If you cancel the order after the goods have been delivered, arrange a refund less collection costs and administration charge which you will be charged according to the goods ordered and area and loaction from where the goods will be collected you could also bring the goods at our warehouse on your own to avoid the collection charges the refund will be done within 30 days. If we believe the product has been used or been tampered with, we preserve the right to refuse an exchange or a refund.
Reasonable care of the goods before they are returned to us, and this result in damage or deterioration, we will charge you for the reduction in value. And accordingly the refund will be processed within 30 days.
All furniture from Italuxe comes with a 1 year guarantee against manufacturing defects. Should a problem arise within this period the furniture will be repaired or replaced.
Replacement of damaged goods
Goods that are damaged on arrival with the customer will be replaced at no additional cost. It is in the customers own interests to unwrap and fully examine all furniture at the time of delivery.
Customers have up to 7 days following delivery to report damage, but claims must be supported by photographs and it is the responsibility of the customer to show the damage has not been caused by any misuse or mishandling following delivery. All claims must be supported by photographs.
Where items ordered are stock items, we will deliver the item to you within 7 - 21 days.
The average lead time is 6-8 weeks, depending upon the item ordered and the stock availability.
We will keep customers informed if there is any delay on the expected delivery time of goods that has previously been included within the product page on the website.
Tracking Your Delivery
It may be possible to track your order. Please e-mail firstname.lastname@example.org giving details of your order number and Italuxe will be able to inform you of the status of your order.
Please note that Italuxe will only contact you with regards to delivery if, the product(s) has arrived into our depot / logistics company and are ready for delivery.
The product delivery time is delayed longer than mentioned.
Confirming the Delivery Date
Once your item(s) is ready for dispatch either we will contact you or our contracted delivery service will contact you in order to arrange a mutually suitable delivery date.
Available days for delivery are Monday - Saturday between the hours of 10.00am - 7.00pm.
If a price has been shown incorrectly on the Italuxe website, the company reserves the right to cancel any customer orders placed at that price and return in full any payment received.
Goods which are ordered to a specification or finish cannot easily be offered for resale, so they are classed as special order items. Customers who cancel a special order are liable for the costs incurred by Italuxe. This includes any carriage costs incurred or any charges made to us by the manufacturer. If a special made to order item are cancelled the refund will be processed deducting the charges incurred which would be 50% of the sale price.
Use of Italuxe web site
Italuxe owns the copyright and all other intellectual property of, or has the right to use and make available for purchase where relevant, all material on the site including but not limited to the text, graphics, logos and all other material available or downloaded through the site.
Variation of Terms & Conditions
Italuxe reserves the right to change these Terms & Conditions at any time and without notice. You will be bound by these modifications when you use the site, and should periodically read these Terms.
